Terms of Service

1. Who we are and what these terms cover

ZTweaks (“ZTweaks”, “we”, “us”, “our”) sells downloadable software for Windows PCs: optimisation tools that adjust operating-system, BIOS-level, driver and network settings, and macro tools that automate keyboard, mouse and controller input for games such as Fortnite (together, the “Software”). These Terms of Service (the “Terms”) govern every purchase, download, installation and use of the Software, our website, and our Discord community (the “Services”).

By purchasing, downloading, installing or using the Software, or by using the Services, you confirm that you have read, understood and agreed to these Terms in full. If you do not agree, do not purchase, install or use the Software.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to purchase the Software. If you are younger, a parent or legal guardian must make the purchase, accept these Terms on your behalf and supervise your use. By purchasing you confirm that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Licence

When you buy the Software we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use it on the number of PCs shown for the licence you purchased (for example “1 PC”), for your own private, non-commercial use. We do not sell you the Software itself; all rights not expressly granted remain with ZTweaks.

A licence is tied to the purchaser. It may not be shared, lent, rented, sold, sub-licensed, given away or transferred to anyone else, and a single licence may not be used on more PCs than it was purchased for. Moving a licence to a new PC of your own may require you to contact support.

4. What you may not do

You agree that you will not, and will not help anyone else to: copy, share, upload, leak, resell or redistribute the Software or any download link, licence key or account; decompile, disassemble, reverse-engineer, unpack, dump, modify, translate or create derivative works from the Software; bypass, remove or interfere with any licence check, activation, anti-tamper or update mechanism; use the Software, or anything learned from it, to build a competing product; use the Software on a PC you do not own or are not authorised to modify; use the Software for any unlawful purpose, or in any way that harms ZTweaks, its customers or third parties; or misrepresent yourself as ZTweaks or as an authorised seller.

Any of the above ends your licence immediately (see section 16) and may result in a permanent ban from our Services. We reserve the right to pursue any legal remedies available to us.

5. What the Software does — and no guarantee of results

The optimisation tools change system settings that you could, in principle, change yourself. Their effect depends entirely on your hardware, drivers, Windows version, installed software and the games you play. Any performance figures, frame rates, latency numbers or comparisons shown on our website, in our Discord or in creator content are examples from specific systems and are not a promise of what you will see. We do not guarantee any particular improvement, or any improvement at all.

Every setting the optimisation tools apply can be reverted from inside the Software. It remains your responsibility to understand what a tweak does before applying it, and to keep a backup or restore point of your system. You use the Software entirely at your own risk.

6. Games, anti-cheat and third-party rules

Macros may breach a game’s rules. Macro and input-automation tools, including any tool marketed for Fortnite, may be prohibited by the terms of service, end-user licence agreement, community rules or anti-cheat policies of the game or platform you use them with, including those of Epic Games, Inc. Using them can result in warnings, suspensions, temporary or permanent account bans, loss of purchased in-game items, removal from competitions, or forfeiture of prizes.

You are solely responsible for reading and complying with the rules of any game, platform, tournament or anti-cheat system you use the Software with. You decide whether to use a macro, and you accept every consequence of that decision. ZTweaks does not warrant that any part of the Software is permitted by any game or platform, will go undetected, or will not become prohibited in the future. We will not reimburse the cost of the Software, the game, in-game purchases, accounts, prizes or anything else lost as a result of a ban, suspension or penalty.

ZTweaks is an independent product. We are not affiliated with, endorsed by, sponsored by or otherwise connected to Epic Games, Fortnite, Microsoft, Windows, NVIDIA, AMD, Intel, Discord or any other game, platform, hardware or software company. All trademarks belong to their respective owners and are used only to describe compatibility.

7. System changes, stability and hardware

Some optimisation tweaks operate at a low level (for example power plans, timer resolution, kernel and scheduler settings, service and start-up configuration, network stack settings, and settings that mirror BIOS or firmware options). Although every tweak is designed to be reversible, changes of this kind can, in rare cases and on some configurations, cause instability, crashes, boot problems, loss of unsaved work, incompatibility with other software, reduced battery life, higher temperatures, or other unexpected behaviour.

By using the Software you accept these risks. ZTweaks is not responsible for any data loss, downtime, damage to hardware, voided manufacturer warranties, or any other loss arising from applying, combining, misusing or failing to revert tweaks, from using the Software on unsupported hardware or Windows versions, or from changes you make outside the Software. Always keep backups and a Windows restore point.

8. No-refund policy

All sales are final. The Software is a digital product that is delivered instantly and cannot be “returned”. Once your purchase has been completed and the download has been made available to you, no refunds, exchanges or credits will be issued for any reason, including: a change of mind; not reading the product description or these Terms; the Software not producing the results you hoped for; incompatibility with your hardware, Windows version or a game; a game ban, suspension or penalty; or a purchase made by mistake or by another person using your payment method.

Where the law of your country grants you a non-waivable right to a refund for digital content, that right is not affected by this section. By starting the download you expressly consent to immediate delivery and acknowledge that, where applicable, you thereby lose any statutory right of withdrawal.

Opening a chargeback or payment dispute instead of contacting support is treated as a breach of these Terms. We will contest it with our delivery records, and the licence (and any other licences on the same account, email or payment method) will be revoked immediately and permanently.

If something is not working, we want to fix it: open a ticket in our Discord and the support team will work through it with you.

9. Prices, payments and taxes

Prices are shown in the currency displayed at checkout and may change at any time; the price you pay is the one shown when you complete your purchase. Discounts, bundles and promotional prices are available only while displayed and cannot be applied retroactively. You are responsible for any taxes, duties, currency-conversion charges or bank fees that apply to your purchase. If a listing contains an obvious pricing error we may cancel the order and refund the amount paid.

10. Official channels only — avoid unauthorised sellers

The Software is sold only through our official website and the official links posted in our Discord. We do not sell through, and have not authorised, any third-party website, marketplace, reseller, key shop, social-media account or individual. Copies obtained anywhere else may be counterfeit, out of date, modified, bundled with malware, or purchased with stolen payment details.

We provide no licence, support, updates or protection for copies obtained from unofficial sources, we are not responsible for any loss or damage they cause, and we may revoke any licence key that we determine was obtained or resold outside official channels.

11. Support

Support is provided through tickets in our Discord server on a reasonable-efforts basis. We aim to respond as quickly as we can but do not guarantee any response time, resolution, or that every issue on every system can be fixed. Support does not cover problems caused by hardware faults, third-party software, modified copies of the Software, or systems that fall outside the stated requirements. We may decline or end support for anyone who is abusive to our team or other members.

12. Updates, changes and availability

We may update, change, add to, remove from, rename, re-price or discontinue any part of the Software or the Services at any time, with or without notice. Updates may be required for the Software to keep working after changes to Windows, drivers or games; we do not guarantee that any feature will remain available or effective, and a feature ceasing to work or being removed is not grounds for a refund. Licences do not entitle you to future products.

13. Intellectual property

The Software, our website, our branding, names, logos, artwork, videos, text and all related intellectual-property rights are owned by ZTweaks or its licensors and are protected by copyright, trademark and other laws. Nothing in these Terms transfers any of those rights to you. You may not use our name, logos or content to promote anything without our written permission, except as expressly permitted under our affiliate programme.

14. Disclaimer of warranties

The Software and the Services are provided “as is” and “as available”, with all faults and without warranty of any kind. To the fullest extent permitted by law, ZTweaks disclaims all warranties, express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Software will be error-free, uninterrupted, secure, compatible with your system or any game, undetectable by any anti-cheat, or that it will achieve any result. No advice or information from us, our staff, moderators, partners or creators creates any warranty not stated in these Terms.

15. Limitation of liability

To the fullest extent permitted by law, ZTweaks and its owners, staff, moderators, contractors, partners and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, game accounts, in-game items, prizes, tournament eligibility, hardware, or the cost of substitute products, arising out of or relating to the Software, the Services or these Terms, however caused and under any theory of liability, even if we were advised of the possibility of such damages.

Our total aggregate liability for all claims relating to the Software or the Services is limited to the amount you paid us for the specific licence giving rise to the claim in the twelve months before the claim arose. Some jurisdictions do not allow certain exclusions or limitations; in those places our liability is limited to the greatest extent the law allows. Nothing in these Terms excludes liability that cannot be excluded by law.

16. Indemnity

You agree to defend, indemnify and hold harmless ZTweaks and its owners, staff, moderators, contractors, partners and affiliates from and against any claims, liabilities, damages, losses, fines and expenses (including reasonable legal fees) arising out of or connected with your use or misuse of the Software or the Services, your breach of these Terms, your breach of any game, platform or third-party terms, or your violation of any law or the rights of any third party.

17. Termination

These Terms apply for as long as you use the Software or the Services. We may suspend or terminate your licence and your access to the Services immediately, without notice or refund, if you breach these Terms, open a chargeback, abuse our team or community, or if we reasonably believe your use is unlawful or harmful. On termination you must stop using the Software and delete all copies. Sections 4, 5, 6, 7, 8, 13, 14, 15, 16, 19 and 20 survive termination.

18. Community conduct

Our Discord server has its own rules, which form part of these Terms while you are a member. Harassment, scamming, sharing or requesting leaked copies of the Software, advertising competing or unauthorised products, and impersonating staff will result in removal and may result in loss of your licence.

19. Privacy

We collect only the information needed to process your order, deliver the Software and provide support (such as your email address, order details and any information you send us in a ticket). Payments are processed by our payment provider; we never see or store your full card details. The Software does not collect or transmit your personal data beyond what is required to verify your licence. Our full Privacy Policy explains this in detail.

20. Governing law and disputes

These Terms, and any dispute or claim arising out of or in connection with them or the Software, are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law rules, and the state and federal courts located in New Jersey have exclusive jurisdiction, except where the mandatory consumer-protection law of your country of residence provides otherwise. Before starting any formal proceedings you agree to contact us first and give us a reasonable opportunity to resolve the issue.

If any part of these Terms is found to be unenforceable, the rest remains in full effect. Our failure to enforce any provision is not a waiver of it. These Terms are the entire agreement between you and ZTweaks about the Software and replace any earlier terms, descriptions or statements. You may not assign these Terms; we may assign them to a successor of our business.

21. Changes to these Terms

We may update these Terms from time to time. The current version is always published on this page with its effective date, and changes take effect when posted. Continuing to use the Software or the Services after a change means you accept the updated Terms. If you do not accept a change, stop using the Software.
